A General Power of Attorney gives someone the authority to handle your legal affairs if you are unable to do so. For example, you may be out of the country or unwell and consequently need to appoint someone else to sign paperwork on your behalf. A General Power of Attorney is also useful if you need to give someone the power to act as if they were you regarding a specific issue or matter, or for a short period of time.
The General Power of Attorney can only be used when you still have mental capacity. If you need a power to last beyond this, a Lasting Power of Attorney would be required. Alternatively, if mental capacity has been lost, a Deputyship Order will need to be applied for.
How does the process work?
Once we have taken instructions, the General Power of Attorney can be prepared and the client is invited to attend a meeting with us at our offices in order to complete the form.
Once the form is signed, it is ready to be used and we generally provide certified copies for the clients own records.
How long does it take?
A General Power of Attorney can be prepared quickly as soon as we have full instructions and it takes effect as soon as it has been signed.

It is important that a client thinks carefully about who they wish to have as their Attorneys, as they would be making important decisions on the client’s behalf. The client should also consider the timeframe they would like the power to last for and whether it needs to be restricted to only deal with specific matters.
