Recent case law has shown that employers cannot rely on the ‘reasonable steps’ defence to defend claims for discrimination or harassment, where an employer has not refreshed its equality and diversity training for staff, or where the behaviour of employees indicates that the past training was not effective. Many employers offer straightforward, on-line training on equality and diversity at the point that employees commence work at an organisation. If this is a one-off training, or if, despite the training, there is a culture of potentially discriminatory ‘banter’ it is likely that this training will be found to be inadequate by an Employment Tribunal.
