Master of the Rolls Stays Existing Possession Proceedings

The Master of the Rolls has announced that all court proceedings for possession brought under CPR Part 55 and all proceedings seeking to enforce an order for possession by a warrant or writ of possession are stayed until 25 June 2020.

On 27 March 2020 the Master of the Rolls announced an amendment to the Civil Procedure Rules that will stay all ongoing residential possession proceedings. CPR 51Z follows the Government’s announcement of a support package for residential tenants and landlords affected by the Covid-19 coronavirus.

Those measures included a complete ban, in place for at least three months, on new eviction proceedings against tenants in both social housing and privately rented accommodation but did not address ongoing proceedings. This new practice direction follows the Coronavirus Act 2020 emergency legislation to fill that lacuna and has stayed all existing proceedings to prevent imminent evictions and delay possession proceedings.
