DEADLINE TO PROTECT ASSURED SHORTHOLD TENANCY DEPOSITS RECEIVED BEFORE APRIL 2007

Today is the last day for landlords to comply with their obligation to protect deposits received from assured shorthold tenants where the tenancy deposit was received before 6 April 2007 and the tenancy has continued on since then without being renewed.

The De-regulation Act 2015 introduced a new section into the Housing Act 2004 which extended the Tenancy Deposit Scheme requirements to assured shorthold tenancies created before 6 April 2007.

If by today the landlord has not protected the deposit within a Tenancy Deposit Scheme and provided appropriate information to the tenant then financial penalties may apply and the landlord may be unable to recover possession of his property.

If you are holding a deposit and have not arranged for it to be protected within a Tenancy Deposit Scheme then you should take immediate advice to comply with the legislation.
