Late payments and unpaid invoices can have a serious financial impact on individuals and businesses alike. At Grant Saw Solicitors, our experienced debt recovery solicitors, based in Greenwich, Blackheath and across the South East are ready to help you recover money owed to you quickly, efficiently and cost-effectively.
Our team handles straightforward and complex debt recovery matters, providing clear advice on the best steps to take and ensuring you achieve the strongest possible outcome.
County Court claims for debt recovery
While strong credit control procedures help prevent issues, formal legal action is sometimes necessary. Our debt recovery solicitors can:
- Issue a County Court Claim on your behalf
- Pursue repayment through the formal court process
- Use the claim to apply pressure on the debtor to settle, as a County Court Judgment (CCJ) can damage their credit rating
In many cases, issuing a claim is enough to encourage prompt repayment.
County Court Judgments (CCJs)
If your claim succeeds, the court will grant a County Court Judgment, requiring the debtor to pay the outstanding sum, plus applicable interest and some legal costs depending on the value of the claim. If they fail to pay within 30 days, the CCJ will remain on their credit record for six years.
If the debtor still refuses to pay, our solicitors will advise you on the most effective enforcement options, including:
- Bailiff or High Court Enforcement Officers
- Charging orders
- Attachment of earnings
- Third-party debt orders.
Insolvency action in debt recovery
If the debtor is based in England or Wales and does not dispute the debt, insolvency proceedings may be appropriate. Our debt recovery team can assist with:
- Statutory demands
- Winding-up petitions for companies (debts over £750)
- Bankruptcy petitions for individuals (debts over £5,000)
This can be a powerful tool where the debtor has assets or is refusing to engage.
