Quick Turnaround Settlement Agreements

Quick Turnaround Settlement Agreements

If you have been offered a settlement agreement, you will need independent legal advice from settlement agreement solicitors before signing it. We provide fast, clear and pragmatic advice to help you understand your position and make the decisions that are right for you.

Our employment team advises employees and senior executives on settlement agreements in all situations, whether it is in a redundancy context, the result of a workplace dispute or part of a negotiated exit.

We offer a quick turnaround service, aiming to review and advise you in full detail on your settlement agreement within 2 working days of having completed our client on-boarding procedures.

Whether your settlement agreement arises because of a proposed redundancy, as the result of problems in the working relationship, or for some other reason, we explain:

  • your legal rights and how the enhanced terms offered in the settlement agreement compare with what you might obtain from an employment tribunal
  • the terms of the settlement agreement and how to make sure you comply with it
  • the alternative options that you may want to consider.

In most cases, your employer will meet our legal fees for reviewing your settlement agreement in accordance with the legal requirement and for signing the certificate of advice to make it legally binding. This is standard practice.

If you would like additional advice and assistance, for example to help you in negotiating the settlement agreement, we will agree the objectives and the cost of this work with you, so that there are no unexpected costs.

Quick Turnaround COT3 agreements (ACAS settlements)

If you have started ACAS early conciliation and you have reached an agreement in principle on the settlement of your legal claims, the terms of this settlement may be documented as a COT3 agreement, rather than as a standard settlement agreement. A COT3 is a legally binding agreement reached via ACAS.

We can advise on the COT3 agreement in much the same way as a settlement agreement, ensuring you understand the legal implications before you agree to its terms.  In this case also, your employer may agree to meet your legal costs of this advice but, if they do not do so, we will offer you cost-effective and quick assistance.
